Arbitration Fee Calculator in Iran's Legal System

Arbitration Fee Calculator in Iran's Legal System

Access Link: dadlist.ir/davari

In the Iranian legal system, if the parties involved in a dispute and the appointed arbitrator do not have a pre-existing, explicit financial agreement, the arbitration fees are not arbitrary. Instead, they are strictly regulated by a specific legal framework. This calculator is fully developed based on the "Bylaw on Arbitration Fees, approved on August 27, 2022 (1401/06/05 in the Iranian calendar) by the Head of the Judiciary of Iran." It operates on the assumption that there is no mutual financial agreement between the parties and the arbitrator.

One of the main features that distinguishes this tool from other available ones is the smart calculation of multiple claims (which implements the logic of Article 4 of the Iranian Bylaw). One of the complexities of calculating arbitration fees in Iran arises when a plaintiff files several claims simultaneously. To address this, the tool asks you a crucial legal question: Are the claims related and do they stem from the same origin, or are they independent?

If they are related: The system automatically considers the fee for the single claim with the highest financial value as the total arbitration fee.

If they are independent: It calculates the legal fee for each claim separately and ultimately adds them together.

The calculation is performed in 3 simple steps (type of claim, relief sought/amount, and number of arbitrators) to ensure nothing is overlooked.

As with my previous legal tools, the Official Gazette version and the officially promulgated version of the bylaw (as PDF files) are provided for download at the bottom of the page for your reference.

If you notice any calculation errors or discrepancies with the Iranian bylaw under various testing scenarios, I would be very grateful if you could let me know so I can fix it as soon as possible.

I hope this tool proves useful for dear lawyers, respected arbitrators, and the general public navigating the Iranian arbitration system.
